Terms & Conditions

These Terms & Conditions govern your use of the Byars website (byars.com.au) and any order you place with us. Byars is a trading name of Byars Hospitality, Cleaning & Packaging Supplies, ABN 46 649 787 388. By using our website or placing an order, you accept these Terms & Conditions.

1. Pricing and payment

Where you hold an approved account with Byars, orders are priced at the rates agreed with you and confirmed on your invoice. Where no rate has been agreed for a product, we will confirm pricing with you before the order is dispatched.

Prices are exclusive of GST unless stated otherwise. We reserve the right to change prices at any time; any change to an agreed rate will be communicated to you before it applies to an order.

Payment is due in accordance with the terms of your account. Where you do not hold an approved credit account, payment must be received in full before goods are dispatched.

2. Order acceptance

Receipt of an order confirmation does not guarantee acceptance of your order. We reserve the right to decline or cancel any order, including where a product is unavailable, a pricing or listing error has occurred, or we suspect fraudulent activity.

Where we cancel an order after payment has been made, we will provide a full refund.

Custom print and equipment orders accepted via a signed quotation are governed by our separate Custom Print & Equipment Terms & Conditions, which take precedence over these Terms for those orders.

3. Delivery

Geelong deliveries are generally scheduled for the next business day. Bellarine and Torquay are serviced twice weekly, and the remaining approved towns are serviced weekly. Contact Byars to confirm the run for your location.

Deliveries outside the local Geelong region are made in line with our delivery run schedule, which is available on request, subject to product availability.

There is one flat delivery fee, whatever the order size, on all deliveries made on Byars vehicles. Freight charges apply to deliveries outside this schedule and are calculated on the size and weight of the order; we will confirm any freight charge with you before dispatch.

Delivery timing is subject to product availability and the scheduled run. Estimated delivery times are a guide only and Byars will not be held responsible for delays.

Products on back order will be dispatched on the next available delivery schedule.

4. Returns

Products may be returned for a refund, exchange or credit note within 14 days of receiving the goods, provided the products are returned in their original condition and packaging.

Byars must be contacted prior to the return for authorisation. Delivery costs for returned products are at the customer's expense.

Returns outside this policy may be subject to a 20% restocking fee, where Byars agrees to accept the return.

Special orders and indent items

Products ordered as a special order or indent item — including goods not normally held in stock and sourced specifically for a customer — are non-returnable for change of mind. Where Byars agrees to accept a change-of-mind return on a special order or indent item, this will be subject to a restocking fee of at least 20%, reflecting that the goods may not be resaleable through normal stock.

Any variation to these terms must be agreed in writing by Byars before the order is placed.

5. Your consumer guarantees

Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you under the Australian Consumer Law, or any other applicable law, that cannot lawfully be excluded, restricted or modified.

Our returns policy operates in addition to, and does not limit, your rights under the Australian Consumer Law, including your rights in relation to faulty, unsafe or not-as-described goods.

6. Limitation of liability

To the maximum extent permitted by law, Byars is not liable for any indirect, incidental or consequential loss or damage arising from your use of our website or products, except where such liability cannot be excluded under the Australian Consumer Law.

Where permitted by law, our liability for any claim is limited, at our option, to the resupply of the goods or services, or the cost of resupply.

7. Product descriptions and images

Product images and descriptions on our website are provided as a guide only. Actual colours, packaging and specifications may vary slightly from those displayed.

Where a product is described as certified to a particular standard, that description is based on documentation provided by the manufacturer or supplier.

8. Intellectual property

All content on our website, including text, images, logos and product descriptions, is the property of Byars or its licensors and must not be reproduced without our permission.

9. Website use

You agree to use our website lawfully and not to misuse it in any way that could damage, disable or impair the site or interfere with any other party's use of it.

Where you hold an account, you are responsible for keeping your login details secure and for orders placed through your account.

10. Privacy

Your personal information is handled in accordance with our Privacy Policy, available at byars.com.au/privacy-policy.

11. Changes to these Terms

These Terms & Conditions may change from time to time and any changes will be posted on this page. These Terms were last updated on 24 September 2026.

12. Governing law

These Terms & Conditions are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of that state.
